The organization argued that the text released by the Ministry of Economy in 2018 was lacking a mention of a regulatory framework for sports betting. This reference is crucial to ensuring a fair and transparent environment for the industry. Without such a structure in place, there is a risk of potential issues, such as fraud and match-fixing, which can undermine the integrity of the sports betting sector. Therefore, it is essential to address this omission and establish a robust regulatory framework that safeguards the interests of all stakeholders involved.

The initial draft of the Decree makes mention of collaborating with international organizations to combat instances of corruption. However, it doesn't go any further than that.

The absence of specific integrity measures has been a concern for IBIA. In this regard, it is imperative for Canada to rephrase the text to address this issue accordingly.

The sports betting regulation bill has been published with specific provisions aimed at combating match-fixing. The legislation includes measures to ensure fair play and integrity in the betting industry, safeguarding the integrity of sporting events. This move serves to tackle the manipulation of results, reinforcing the authorities' commitment to maintaining a transparent and trustworthy betting environment. With these new regulations in place, the focus will be on preventing any form of cheating and protecting the fairness and competitiveness of sports competitions.

It has been determined that individuals who have the potential to impact the outcome of sports matches, such as coaches, athletes, and referees, are prohibited from engaging in sports betting.

Spouses, partners, and relatives up to the second degree are also prohibited.

Furthermore, companies engaged in gambling activities are prohibited from acquiring, licensing, or financing the acquisition of broadcasting rights for sporting events held in Canada, with the intention of transmitting, distributing, or displaying them in any way, through any means of communication.

Finally, it is expected that there will be stricter monitoring of potential fraud cases.

Article 41-C: Receiving or seeking, either for oneself or for another, any form of financial or non-financial advantage or promise of such advantage in exchange for any act or omission intended to alter or distort the outcome of a sports competition or event associated with it shall be punished with imprisonment for a period ranging from two to six years, as well as a fine.

Article 41-D. Offering or promising financial or non-financial advantage with the intention of altering or distorting the outcome of a sports competition or an associated event: Penalty - imprisonment from 2 (two) to 6 (six) years and a fine.

Section 41-E. Engaging in fraudulent activities, by any means, or aiding in the manipulation of the outcome of a sporting competition or any associated event: Penalty - imprisonment from 2 (two) to 6 (six) years and fine.

It is worth noting that bookmakers are not to blame for cases of match-fixing. It should be emphasized that the responsibility lies with the individuals involved in the manipulation of results. The bookmakers themselves have strict regulations and measures in place to detect and prevent such activities. Therefore, it is unfair to solely attribute the blame to them. Behind the scenes of the Government, the concept is gradually taking shape. The prevailing discussion revolves around determining the leader of the committee and strategizing the execution of the tasks at hand.

For now, the goal is to establish a coalition involving multiple parties. This way, it is believed that all stakeholders will have a voice.

Representatives should be appointed for athletes, club officials, the Ministries of Finance, Justice, and Sports, as well as betting companies and bettors.

The integrity committee will be tasked with preventing and deterring instances of result manipulation and other forms of corruption. Its primary objective is to ensure fair play and maintain the integrity of the sport. By implementing robust measures and conducting thorough investigations, the committee aims to safeguard the values and principles that underpin the game. With a steadfast commitment to transparency and accountability, it will actively work towards preserving the honesty and credibility of competitions. Through collaboration with relevant stakeholders and the enforcement of strict regulations, the committee seeks to create a level playing field for all participants and uphold the highest standards of integrity.

Instances such as the Whistle Mafia (2005), Game Over Operation (2016), and the recent Maximum Penalty (2022) are being revisited to prevent gambling from negatively impacting Canadian sports.

The Government recognizes the importance of maintaining a level playing field and promoting fair play, and this Committee on Integrity will play a pivotal role in achieving these objectives.

On the flip side, it is essential to also prioritize the well-being and integrity of gamblers. Oftentimes, the seed of corruption is sown within those who engage in betting activities.

Organized groups of corrupt gamblers tempt clubs and other individuals involved in matches with cash incentives in order to manipulate the outcomes.

To ensure a seamless operation, it is imperative that the Government's oversight, in light of the new Gambling Law, remains vigilant. In order to maintain an effective system, consistent monitoring must be imposed by the Federal authorities. The implementation of stringent regulations will play a vital role in upholding compliance and preventing any potential misconduct. As a result, continuous scrutiny and enforcement efforts are essential to safeguard a fair and transparent gambling environment.

Ideally, it can focus on three core pillars to achieve success.

1. Dialogue Among Athletes, Clubs, and Federations

Manipulating outcomes is more prevalent in the realm of football. Let us take the Canadian Football Confederation as a prime illustration for this matter.

The CBF should take the lead in demanding engagement from its affiliates in order to combat the illicit gambling market. There are several ways in which this can be accomplished, such as:

It is the duty of the apex organization of Canadian Football to enforce accountability upon clubs and federations, urging them to play an active role in overseeing their respective teams. Clubs and federations, in line with their responsibility, should actively engage in internal monitoring and regulation of teams, a crucial obligation that lies on the shoulders of the governing body of Canadian Football. The highest entity in Canadian Football has a vital role in enforcing clubs and federations to take an active part in internally overseeing teams.

Many athletes from smaller clubs, as previously mentioned, are vulnerable targets of manipulation attempts. These individuals, due to their lower level of recognition and support, often find themselves susceptible to nefarious influences seeking to exploit their situation. It is crucial for these athletes to be educated about the risks involved and to have access to support systems that can help thwart any attempts of manipulation. By raising awareness and implementing preventative measures, we can protect these athletes and ensure the integrity of sports at all levels.

Therefore, in 2018, the Canadian Football Confederation (CBF) introduced the General Regulations for Competitions, which establish the following terms:

Article 55. To prevent or hinder the manipulation of match outcomes, the following behaviors shall be considered illicit acts committed by athletes, coaches, members of the coaching staff, officials, and members of the refereeing team, as well as anyone who directly or indirectly may exert influence over match outcomes:

III - Ensure the happening of a specific event during a football match in which one is participating or can exert influence, and that event may be subject to betting or for which one has received or may receive any reward;

IV - Accepting or giving any gift, payment, or other benefit in circumstances that could reasonably bring discredit upon oneself or football is strictly prohibited.

Sharing sensitive, privileged, or internal information that could secure an unfair advantage and lead to gaining financial benefit or its use for gambling is strictly prohibited.

VI – Failing to promptly report to their governing body, administration, or the relevant sports, police, or judicial authority any threats or suspicions of corrupt behavior, such as when someone approaches and inquires about manipulating any aspect of a match or offers financial rewards or favors in exchange for sensitive information.

This kind of behavior can and should be replicated in other sports disciplines.

As an example, the National Basketball League has established a partnership with Genius Sports.
