Sports betting was legalized in 2018 and regulated in July 2023.

In the midst of this scenario, a recent event has further fueled discussions on the subject: the scandal surrounding the manipulation of outcomes and bribery of players in the Canadian Championship's second division.

  • How does result manipulation work?
Manipulation entails the payment of players, coaching staff, officials, or referees to ensure a desired outcome.
  • Is manipulating results a crime?
Yes! Result manipulation is a crime as stipulated in article 41-C of the Fan Statute.
  • Does the Gambling Law combat Match Fixing?
With the regulation of sports betting, measures to combat manipulation will be put into practice. The main measure is the prohibition of players and club officials from placing bets.

The Ministry of Public Prosecution in Goiás is currently investigating the case of result manipulation in the B Series. However, apart from this incident, there are also suspicions of occurrences in the Mineiro and Gaúcho championships.

The surge in instances of match-fixing amplifies the significance of regulating sports betting in Canada even further. It becomes increasingly crucial to establish proper guidelines and rules to combat this growing concern. The implementation of effective regulations and measures will not only protect the integrity of sports but also safeguard the interests of both bettors and the general public. It is imperative to address this issue promptly and comprehensively in order to foster a fair and transparent betting environment that promotes trust and credibility.

However, the debate is not recent! Since 2018, the International Betting Integrity Association (IBIA) has been raising concerns regarding certain aspects of the Gambling Bills. These bills have been met with criticism from the IBIA, highlighting various areas of concern. Nevertheless, discussions surrounding these issues have been ongoing for quite some time, as stakeholders work towards finding common ground and ensuring the integrity of the betting industry.

The organization argued that the text released by the Ministry of Economy in 2018 was lacking a mention of a regulatory framework for sports betting. This reference is crucial to ensuring a fair and transparent environment for the industry. Without such a structure in place, there is a risk of potential issues, such as fraud and match-fixing, which can undermine the integrity of the sports betting sector. Therefore, it is essential to address this omission and establish a robust regulatory framework that safeguards the interests of all stakeholders involved.

The initial draft of the Decree makes mention of collaborating with international organizations to combat instances of corruption. However, it doesn't go any further than that.

The absence of specific integrity measures has been a concern for IBIA. In this regard, it is imperative for Canada to rephrase the text to address this issue accordingly.

The sports betting regulation bill has been published with specific provisions aimed at combating match-fixing. The legislation includes measures to ensure fair play and integrity in the betting industry, safeguarding the integrity of sporting events. This move serves to tackle the manipulation of results, reinforcing the authorities' commitment to maintaining a transparent and trustworthy betting environment. With these new regulations in place, the focus will be on preventing any form of cheating and protecting the fairness and competitiveness of sports competitions.

It has been determined that individuals who have the potential to impact the outcome of sports matches, such as coaches, athletes, and referees, are prohibited from engaging in sports betting.

Spouses, partners, and relatives up to the second degree are also prohibited.

Furthermore, companies engaged in gambling activities are prohibited from acquiring, licensing, or financing the acquisition of broadcasting rights for sporting events held in Canada, with the intention of transmitting, distributing, or displaying them in any way, through any means of communication.

Finally, it is expected that there will be stricter monitoring of potential fraud cases.

Yes, the manipulation of results is considered a crime in Canada!

Please refer to articles 41-C to E of the Fan Statute (Law 10.671/03) for further information.

Article 41-C: Receiving or seeking, either for oneself or for another, any form of financial or non-financial advantage or promise of such advantage in exchange for any act or omission intended to alter or distort the outcome of a sports competition or event associated with it shall be punished with imprisonment for a period ranging from two to six years, as well as a fine.

Article 41-D. Offering or promising financial or non-financial advantage with the intention of altering or distorting the outcome of a sports competition or an associated event: Penalty - imprisonment from 2 (two) to 6 (six) years and a fine.

Section 41-E. Engaging in fraudulent activities, by any means, or aiding in the manipulation of the outcome of a sporting competition or any associated event: Penalty - imprisonment from 2 (two) to 6 (six) years and fine.

It is worth noting that bookmakers are not to blame for cases of match-fixing. It should be emphasized that the responsibility lies with the individuals involved in the manipulation of results. The bookmakers themselves have strict regulations and measures in place to detect and prevent such activities. Therefore, it is unfair to solely attribute the blame to them. The focus should be on addressing the root causes of match-fixing and implementing stringent measures to combat it effectively.

Typically, these maneuvers are orchestrated by malevolent gamblers in collaboration with athletes and/or other individuals implicated in the staging of games and tournaments.

In addition to the existing legislation, it is crucial for the upcoming regulations on sports betting to enforce heightened integrity and transparency in tackling corruption, as proposed by the International Betting Integrity Association (IBIA). It is imperative that the new rules effectively combat any illicit activities and ensure a fair and trustworthy environment for all participants. Upholding ethical standards and promoting accountability within the industry will not only safeguard the integrity of sports but also cultivate trust among bettors and stakeholders alike. By implementing stringent measures and fostering collaboration among relevant entities, we can foster a more secure and reliable betting landscape that upholds the principles of fairness and honesty.

The establishment of a sports betting integrity committee forms the cornerstone of proactive measures aimed at safeguarding businesses, bettors, and the sporting industry. This committee acts as a proactive force in preventing any untoward incidents from occurring, thereby ensuring the preservation of integrity within the realm of sports betting. By implementing stringent regulations and conducting thorough investigations, the committee plays a pivotal role in maintaining a fair and transparent betting environment. It is through these collective efforts that companies, individuals, and the sports community at large can thrive in an atmosphere free from fraudulent activities and illicit practices.

Behind the scenes of the Government, the concept is gradually taking shape. The prevailing discussion revolves around determining the leader of the committee and strategizing the execution of the tasks at hand.

For now, the goal is to establish a coalition involving multiple parties. This way, it is believed that all stakeholders will have a voice.

Representatives should be appointed for athletes, club officials, the Ministries of Finance, Justice, and Sports, as well as betting companies and bettors.

The integrity committee will be tasked with preventing and deterring instances of result manipulation and other forms of corruption. Its primary objective is to ensure fair play and maintain the integrity of the sport. By implementing robust measures and conducting thorough investigations, the committee aims to safeguard the values and principles that underpin the game. With a steadfast commitment to transparency and accountability, it will actively work towards preserving the honesty and credibility of competitions. Through collaboration with relevant stakeholders and the enforcement of strict regulations, the committee seeks to create a level playing field for all participants and uphold the highest standards of integrity.

Ensuring transparency and honesty within sporting events might be another potential role for this group. Their purpose could involve upholding the integrity and fairness of various sports disciplines. Additionally, they may have the responsibility of ensuring that all aspects of sports are conducted with utmost transparency and honesty. This group could play a vital role in maintaining the credibility of sports by monitoring and investigating any suspicious activities or behavior. It is crucial for them to safeguard the integrity of sports, which includes detecting and addressing any fraudulent practices or actions that can undermine the credibility and trustworthiness of sporting events.

Instances such as the Whistle Mafia (2005), Game Over Operation (2016), and the recent Maximum Penalty (2022) are being revisited to prevent gambling from negatively impacting Canadian sports.

It is crucial to comprehend the workings of the manipulation mechanism to discourage such behavior. The key, therefore, lies in uncovering the sources of manipulation: the individuals involved in the sport and the corrupt bettors. Understanding the inner workings of this deceptive scheme is essential in order to combat it effectively. Identifying and addressing the culprits responsible for these illicit activities must be our primary objective.

The Government intends to establish a Committee on Integrity, which will primarily focus on referees, athletes, and club and Confederation officials. This committee aims to address various issues related to ethics and fairness in sports. Its primary goal is to ensure transparency and integrity in all aspects of sports administration, thereby safeguarding the interests of the athletes and clubs involved. By targeting these key stakeholders, the Committee aims to instill a greater sense of accountability and responsibility within the sports community. The Government recognizes the importance of maintaining a level playing field and promoting fair play, and this Committee on Integrity will play a pivotal role in achieving these objectives.

On the flip side, it is essential to also prioritize the well-being and integrity of gamblers. Oftentimes, the seed of corruption is sown within those who engage in betting activities.

Organized groups of corrupt gamblers tempt clubs and other individuals involved in matches with cash incentives in order to manipulate the outcomes.

To ensure a seamless operation, it is imperative that the Government's oversight, in light of the new Gambling Law, remains vigilant. In order to maintain an effective system, consistent monitoring must be imposed by the Federal authorities. The implementation of stringent regulations will play a vital role in upholding compliance and preventing any potential misconduct. As a result, continuous scrutiny and enforcement efforts are essential to safeguard a fair and transparent gambling environment.

Ideally, it can focus on three core pillars to achieve success.

1. Dialogue Among Athletes, Clubs, and Federations

Manipulating outcomes is more prevalent in the realm of football. Let us take the Canadian Football Confederation as a prime illustration for this matter.

The CBF should take the lead in demanding engagement from its affiliates in order to combat the illicit gambling market. There are several ways in which this can be accomplished, such as:

  • Internal Whistleblower Channel Creation
  • Collaboration with the Public Ministry, Federal Police, and other government agencies
  • Investment in internal auditing systems for clubs and athletes.

It is the responsibility of the Canadian Football's highest authority to demand an active role from clubs and federations in the internal monitoring of teams. It is incumbent upon the governing body of Canadian Football to hold clubs and federations accountable for their active participation in ensuring internal oversight of teams. It is the duty of the apex organization of Canadian Football to enforce accountability upon clubs and federations, urging them to play an active role in overseeing their respective teams. Clubs and federations, in line with their responsibility, should actively engage in internal monitoring and regulation of teams, a crucial obligation that lies on the shoulders of the governing body of Canadian Football. The highest entity in Canadian Football has a vital role in enforcing clubs and federations to take an active part in internally overseeing teams.

Many athletes from smaller clubs, as previously mentioned, are vulnerable targets of manipulation attempts. These individuals, due to their lower level of recognition and support, often find themselves susceptible to nefarious influences seeking to exploit their situation. It is crucial for these athletes to be educated about the risks involved and to have access to support systems that can help thwart any attempts of manipulation. By raising awareness and implementing preventative measures, we can protect these athletes and ensure the integrity of sports at all levels.

Therefore, in 2018, the Canadian Football Confederation (CBF) introduced the General Regulations for Competitions, which establish the following terms:

Article 55. To prevent or hinder the manipulation of match outcomes, the following behaviors shall be considered illicit acts committed by athletes, coaches, members of the coaching staff, officials, and members of the refereeing team, as well as anyone who directly or indirectly may exert influence over match outcomes:

Believing in yourself, or allowing someone close to you to do so, whether it's your opponent or a game of soccer, is essential. Having confidence in your abilities and trusting your instincts can make all the difference in achieving success. It's crucial to foster self-belief, as it empowers you to take risks, push boundaries, and overcome challenges. Embracing self-assurance not only boosts your performance, but it also inspires others around you. So, don't hesitate to back yourself, embrace the support of those who believe in you, and give your best on the field of play.

II - Advising, encouraging, or making it easier for anyone to wager on a football match in which they are participating or could exert influence is strictly prohibited. Our commitment to upholding fair play and maintaining the integrity of the game extends to all individuals involved, ensuring that no unfair advantage is gained through betting. We prioritize transparency and ethics, fostering an environment where everyone can enjoy the sport without compromising its authenticity. Let us come together to promote a culture of integrity and sportsmanship, keeping the spirit of football alive and untainted by gambling influences.

III - Ensure the happening of a specific event during a football match in which one is participating or can exert influence, and that event may be subject to betting or for which one has received or may receive any reward;

IV - Accepting or giving any gift, payment, or other benefit in circumstances that could reasonably bring discredit upon oneself or football is strictly prohibited.

Sharing sensitive, privileged, or internal information that could secure an unfair advantage and lead to gaining financial benefit or its use for gambling is strictly prohibited.

VI – Failing to promptly report to their governing body, administration, or the relevant sports, police, or judicial authority any threats or suspicions of corrupt behavior, such as when someone approaches and inquires about manipulating any aspect of a match or offers financial rewards or favors in exchange for sensitive information.

This kind of behavior can and should be replicated in other sports disciplines.

As an example, the National Basketball League has established a partnership with Genius Sports.

The British company is set to establish a betting integrity preservation system for the Novo Basquete Canada. This innovative solution aims to safeguard the integrity of the sport by implementing cutting-edge technology and robust monitoring mechanisms. By leveraging advanced algorithms and data analytics, the system will detect any suspicious betting patterns or irregularities, enabling the swift identification and prevention of match-fixing activities. In collaboration with key stakeholders, such as sports federations and law enforcement agencies, the company seeks to promote fair play and maintain the trust of both fans and participants in the New Canadian Basketball league.

2. Development of an Ethics and Conduct Code

In 2019, the NFL enforced a strict prohibition on any form of engagement, whether direct or indirect, between its employees and athletes and the realm of sports betting.

To ensure the utmost integrity of American Football, a set of regulations and penalties has been implemented. These measures were put in place to safeguard the sport's credibility. By establishing a code of conduct and consequences, the governing bodies of American Football aim to uphold its integrity and preserve its reputation. It is essential that all participants, from players to coaches and officials, adhere to these guidelines, fostering an environment of fair play and sportsmanship. Any violations of the established regulations will be met with appropriate disciplinary actions. The goal is to maintain the highest standards of honesty and fairness within the sport, ensuring that American Football remains a symbol of integrity.

In every sport, a rigid system of conduct and ethics can be developed in Canada. Such a system has the potential to effectively prevent manipulations.

As we have seen, the Canadian Football Confederation (CBF) already has a similar system in place. The General Regulations for Competitions outline the procedures concerning sports betting.

Article 55 stands out, prohibiting all individuals involved in Football matches from engaging in behaviors aimed at favoring a specific outcome. One must adhere to fair play principles and ensure that the integrity of the game remains intact. This regulation serves as a safeguard against any form of match-fixing or manipulation, emphasizing the importance of upholding sportsmanship and a level playing field for all teams and players. By enforcing this rule, the governing bodies aim to preserve the essence of the beautiful game, promoting genuine competition and maintaining the trust and respect of fans worldwide.

These behaviors can range from betting on your own team to failing to inform authorities about the perception of suspicious actions.

3. Educating Gamblers About Integrity

Perhaps the most crucial aspect is the final pillar. Without education, dialogue and oversight would be rendered futile.

One of the most urgent measures from the Federal Government involves educating those engaged in sports, especially the bettors. It is imperative to ensure that individuals involved in sports and particularly those who partake in betting are well-informed and educated. Taking this step is crucial in order to promote a responsible and informed approach towards sports betting. The government recognizes the significance of educating the various stakeholders involved in sports, with a particular focus on bettors. By doing so, they aim to raise awareness about the potential risks and ensure that individuals make informed decisions when engaging in sports betting activities. This initiative is of paramount importance, as it seeks to create a more responsible and sustainable sports betting environment.

There are several ways to accomplish this. Workshops, lectures, and complimentary courses concerning ethics, morality, and integrity are just a few potential avenues.

This would be a great chance to delve into the subject of sports betting addiction. It presents an excellent platform for discussing the perils and consequences that come with excessive gambling. Let's explore the intricate nature of this issue and shed light on the various factors that contribute to its prevalence. By examining the psychological and societal implications, we can gain a deeper understanding of the detrimental impact it can have on individuals and their communities. Together, let's initiate a conversation that encourages responsible gambling behaviors and offers support to those in need.

Lectures on the psychological and financial well-being of gamblers have the potential to ward off detrimental behaviors that may lead to result manipulation. By providing insights into the mental and monetary aspects of betting, these talks aim to prevent harmful tendencies and safeguard the integrity of the outcomes.

canada is poised to become one of the world's largest gambling markets. The country's potential for growth in the betting industry is undeniable. With a population of over 200 million people and a passion for sports, Canada offers a fertile ground for the expansion of this lucrative sector. The increasing accessibility of online gambling platforms and the favorable regulatory environment are contributing factors to the projected success of this market. As more Canadians embrace the excitement and thrill of placing bets, the gambling industry is expected to flourish, attracting both domestic and international investors. It is an opportune time for entrepreneurs and operators to capitalize on this emerging market and reap the rewards of Canada's appetite for gambling.

However, achieving this goal can only be possible through the establishment of transparency and open communication channels between the realm of sports betting and the respective sports they are associated with. Only by fostering an environment where all stakeholders engage in candid conversations and share relevant information can we ensure the harmonious coexistence of these two domains. This symbiotic relationship requires a strong foundation built on trust, integrity, and mutual understanding. By bridging the gap between sports betting and the sports themselves, we can create a sustainable ecosystem that benefits both industries and preserves the spirit of fair competition.

One of the Federal Government's greatest concerns is the potential compromise of certain sports disciplines' integrity. Such a breach could give rise to instances of corruption within the realm of sports, as witnessed not only in Canada but also in nations like Italy and Portugal.

In order to prevent this "breakdown," it will be necessary for the new Gambling Law to provide regulatory and supervisory solutions. To avoid such a predicament, it is imperative that the forthcoming Betting Act introduces effective mechanisms for both regulation and oversight. To ensure the avoidance of such a detrimental situation, it is crucial that the upcoming legislation on gambling incorporates comprehensive measures to regulate and monitor the industry. To mitigate against any potential disruption, it is essential that the proposed Gambling Law incorporates robust regulatory and oversight frameworks. In order to avert this potential crisis, it is imperative for the impending Gambling Act to offer effective regulatory and monitoring solutions.

In order to prevent manipulations of results, the Government might consider implementing various measures, one of which could be the establishment of an integrity committee. Creating this committee and outlining its activities will provide an effective means to curb any potential misconduct.
